[A] CARLISLE man has lodged an appeal against a conviction for assaulting a woman in the city.
David Andrew Boswell, 38, was last month found guilty – in his absence – of assaulting Angela Rogers, causing her actual bodily harm. This charge arose out of an incident on January 16. He was convicted by Carlisle magistrates following a trial which he did not attend.
Boswell did appear at the city’s crown court earlier this week, magistrates having ruled at the earlier hearing that he should be sentenced by a judge.
However, Boswell’s barrister, Brendan Burke, confirmed to Judge James Adkin that the defendant had lodged an appeal against his conviction for assault. A time estimate of two hours was given for that appeal hearing, which will take place at the crown court next Wednesday.
“You will be brought to court on that day for your appeal,” said Judge Adkin, who remanded Boswell in custody in the meantime.
“A judge and (two) magistrates can determine whether in fact you are guilty of that assault.”
